Resumption due to errors or omissions in the decision letter
You can ask us to resume a claim if there are errors or omissions in our first decision letter.
If there are errors or omissions in the decision letter, we can resume your claim (resumption based on administrative law).
We can resume a claim on the basis of principles of administrative law if one of the following three requirements is met:
- Factual information is lacking in your case
- There is a substantial claims processing error in your case
- There have been legislative changes with retroactive effect
What the above items have in common is that in principle it must be likely that you will get a higher compensation if we resume your claim.
If this is not likely, we cannot resume your claim.
